OFFICIAL CONTEST RULES [FULL]

OPEN ONLY TO RESIDENTS OF CANADA WHO HAVE REACHED THE AGE OF MAJORITY IN THE PROVINCE OR TERRITORY IN WHICH THEY RESIDE.  NO PURCHASE NECESSARY.

This Contest is brought to you by Dare Foods Limited (the “Sponsor”), 25 Cherry Blossom Rd, Cambridge, ON N3H 4R7

CONTEST CLOSING DATE: July 7, 2024 11:59:59 P.M. ET

Standard data rates apply to entrants who choose to participate in the Contest via a mobile device. Please contact your service provider for pricing and service plan information and rates before mobile device participation.

1. CONTEST PERIODS: The Contest begins May 13, 2024 at 12:01 am ET and ends July 7, 2024, at 11:59 pm ET (“Contest Period”). All entries must be submitted by 11:59:59 PM ET on July 7, 2024 (the “Contest Closing Time”). Entries submitted after the Contest Closing Time will not be accepted. Entries must be submitted during the Contest Period to be eligible for the Daily Prizes and Grand Prize.
2. ELIGIBILITY: The Contest is open to residents of Canada who have reached the age of majority in the province or territory in which they reside as of their date of entry in the Contest (“Entrant” or “Entrants”).
3. An entrant must meet the eligibility requirements set out in these Rules from the time of entry until the time they are confirmed a winner (if they become a winner).
4. The Contest is not open to:
   1. employees, officers and directors of the Sponsor including full-time and temporary associates, and employees, officers and directors, of the Sponsors’ parents, affiliates, subsidiaries, and advertising and promotion agencies (collectively, the “Promotion Parties”), representatives or agents, as applicable; and
   2. the immediate family members (regardless of where they live or with whom they are domiciled) of a person excluded under (a) (whether related to that person or not). For the purposes of these Official Contest Rules, “immediate family” includes husband, wife, spouse, partner, mother, father, brothers, sisters, sons, and/or daughters.

5. HOW TO ENTER: NO PURCHASE NECESSARY. Purchase is not required to enter the Contest and will not improve your chances of winning.

6. There are two (2) ways to participate in the Contest: by purchasing an eligible product(s) and submitting your “Receipt” (as defined below), or by submitting a “No Purchase Entry” (as described below). To enter via either method of entry, take the following steps during the Contest Period to enter this Contest, subject to these Rules, and a chance to win one (1) of the Contest prizes (each a “Prize”, collectively the “Prizes” as further described below):
   1. Purchase Entry. To enter by making a purchase (a “Purchase Entry”), you must purchase at least one (1) of the qualifying Sponsor products from a retailer in Canada during the Contest Period; One (1) qualifying product must be purchased to receive one (1) entry. Multiple product purchases on a single Receipt will qualify for multiple entries to a maximum of three (3) entries per Receipt per day. A list of qualifying products is shown in Exhibit A (each, a “Qualifying Product”). Once you have purchased a Qualifying Product(s), retain and scan your purchase Receipt. Your scanned Receipt must show the retailer from whom the purchase was made, the date, and the Qualifying Product(s) (“Receipt”). Visit the Contest website at https://www.greatsummergiveaway.com (the “Website”) and follow the onscreen instructions to submit your Receipt, and register on the Website, if you have not done so previously, together with information including your name, email address, phone number and mailing address. You will also be required to provide the answer to a mathematical skill-testing question (without any mechanical, electronic or other assistance). Once you have submitted your Receipt, the Sponsor will review it for compliance with these Rules, which decision is subject to further review in accordance with these Rules. If the Receipt is verified, you will receive: (1)  one (1) grand prize entry (a “Grand Prize Entry”),; and (2) one (1)  daily prize entry  (a “Daily Prize Entry”), for a chance to win, subject to further conditions (See Rule 12), plus up to a maximum of two (2) additional Grand Prize Entries and Daily Prize Entries per day of the Contest Period, based on the number of Qualifying Products purchased.
      
      Entry Limit. Limit of one (1) Receipt entry and up to three (3) Qualifying Product purchase entries (a “Qualifying Product Entry”) per person per day. For purposes of these Rules, a ‘day’ is defined as any twenty-four (24) hour period during the Contest Period beginning at 12:00:01 AM ET and ending at 11:59:59 PM ET. Each Receipt qualifies for a minimum of one (1) entry for one (1 ) Qualifying Product Entry, and up to three (3) Qualifying Product Entries purchased on the same Receipt, per person, regardless of the email address, telephone number, or other information provided in the entry form. Once a Receipt has been submitted, any additional entries using such Receipt in excess of this limit will be disqualified and will not constitute eligible entries into the Contest. Further, if any entrant attempts to obtain more than the specified number of entries, the Sponsor may, in its sole and absolute discretion, disqualify the entrant from the Contest and disqualify all of that entrant’s entries.
      
      Important Note: You must keep your original Receipt(s). The Sponsor may request to see it to verify that you are eligible to participate in the Contest. If you are unable to produce your original Receipt on request by the Sponsor, you may be disqualified, in the sole and absolute discretion of the Sponsor, and if disqualified, will forfeit any right to claim a Prize.

   2. No Purchase Entry. To enter without making a purchase (a “No Purchase Entry”, and together with a Purchase Entry, an “Entry”); print your first name, last name, complete mailing address (including postal code), valid email address and telephone number on a piece of paper along with a) an original 500 word response to “What summer means to me” and b) your answer to the following mathematical skill-testing question (which you must answer correctly without any mechanical, electronic or other assistance): [(10 + 2) ÷ 6 = ?] c) Mail it in an envelope with sufficient Canadian postage to: “Dare Foods Great Summer Giveaway Contest” c/o Snipp Interactive Inc P.O. For multiple No Purchase Entries, each entry must be unique and submitted as a separate mail in entry, in a separate envelope (multiple entries in one outer envelope will only qualify as one (1) No Purchase Entry). No Purchase Entries must be handwritten and original and must be postmarked by July 5^th, 2024 to qualify for entry.

      Limit of up to three (3) original No Purchase Entries per day, per person.

      Limit of one (1) Receipt Entry per day, per person.

      A total limit of three (3) contest entries per day, per person, regardless of entry method (Receipt Entry or No Purchase Entry).

7. By participating through either method of entry, you agree to these Rules and to the decisions of the Sponsor, which are final and binding in all respects.
8. Any available opt-in opportunities are not required to enter this Contest, and checking any opt-in boxes will not improve your chances of winning. All entries are subject to verification at any time.
9. The Sponsor reserves the right, in its sole and absolute discretion, to require proof of identity and/or eligibility from any entrant, including without limitation the original Receipt submitted with a Purchase Entry, which proof shall be in the form required by the Sponsor. Failure to provide proof of identity and/or eligibility to the satisfaction of the Sponsor in a timely manner may result in disqualification.

10. Prizes and Odds of Winning: There are two (2) classes of Prizes available to be won at the outset of this Contest, daily prizes (each “Daily Prize)” and one (1) grand prize (the “Grand Prize”) (collectively “Prizes”).
    1. One (1) Grand Prize will be awarded at the end of the Contest Period. The Grand Prize consists of: ten thousand Canadian dollars ($10,000 CAD). The approximate odds of winning the Grand Prize depend on the total number of eligible entries received by the Contest Closing Time.
    2. There are a total of fifty six (56) Daily Prizes available to be won at the outset of this Contest, each consisting of an eGift Card valued at fifty Canadian dollars ($50 CAD), including: 12 x $50 Amazon.ca eGift Card, 12 x $50 Cineplex eGift Card, 12 x $50 Indigo eGift Card, 12 x $50 Sport Chek eGift Card, 8 x $50 Esso eGift Card (Total Value: $2,800 CAD). All Daily Prizes will be awarded based on random draw of all eligible entries received by 11:59:59 PM ET for each contest day. The approximate odds of winning a Daily Prize depend on the number of eligible entries received by 11:59:59 PM ET of a given contest day. All amounts and costs related to any Prizes, including but not limited to all income, sales, use and other taxes (and the reporting thereof) imposed as a result of the award of a Prize, which are not expressly stated as covered by the Sponsor in these Rules are the responsibility of the individual winner. It is the individual winner’s responsibility to understand and abide by any federal, provincial, territorial, local or foreign tax laws that may apply to receipt of a Prize. The eGift Cards are subject to terms and conditions. A person eligible to win a Prize must accept the Prize as awarded, no substitutions will be granted.

       Limit of one (1) Grand Prize and one (1) Daily Prize per person. 

11. HOW TO WIN:

12. There is one (1) GRAND PRIZE available to be won, through random draw of all eligible Entries received during the Contest Period. The odds of winning a Prize depend on the number of eligible Entries submitted and received in accordance with these Rules during the Contest Period.
    1. GRAND PRIZE WINNERS: One (1) random draw will be conducted, by the Sponsor’s agent at 12:00 pm ET on July 10, 2024 at the offices of Sponsor’s agency in Detroit, Michigan from all eligible Entries received during the Contest Period to determine the potential Grand Prize Winner (“Potential Grand Prize Winner”).

13. There are a total of fifty six (56) Daily Prizes available to be won at the outset of this Contest.
    1. DAILY PRIZE WINNERS: Daily Prize winners will be selected by random draw conducted by the Sponsor’s agent in Detroit, Michigan from all eligible Entries received by the end of each contest day to determine the potential Daily Prize winners (“Potential Daily Prize Winner”). Daily Prize draws will be conducted weekly for the 7 contest days prior, starting on May 21.  This will continue for each week of the Contest until the end of the Contest Period and for the full fifty six (56) Daily Prizes. 

14. HOW TO CLAIM A PRIZE:

15. GRAND PRIZE WINNER: The Potential Grand Prize Winner will be notified by phone or email no later than July 17, 2024 (“Notification”). The Potential Grand Prize Winner will be required to: (i) agree and return within two (2) business days a declaration and release form (“Declaration”) confirming, among other things, compliance with the Official Contest Rules, acceptance of the Grand Prize as awarded, and agreeing to indemnify and release the Releasees (defined below); and (ii) agree to receive Grand Prize amount through secure Electronic Funds Transfer, to be declared the Grand Prize winner (the “Grand Prize Winner”). The Sponsor, in its sole discretion, reserves the right to select another Entrant should a selected Entrant fail to do the aforementioned, or if found ineligible for any reason. If a Potential Grand Prize Winner cannot be contacted or fails to respond within ten (10) business days from the date contact is first attempted, they will forfeit their Prize, and an alternate winner may be selected, in the sole discretion of the Sponsor and time-permitting. Under no circumstance will Sponsor or any agent of Sponsor require or request Credit Card information or confidential bank account access or statements.
16. DAILY PRIZE WINNERS: Potential Daily Prize Winners will be notified by phone or email no later than July 17, 2024 (“Notification”). The Potential Daily Prize Winners may be required to: (i) agree and return within two (2) business days a declaration and release form (“Declaration”) confirming, among other things, compliance with the Official Contest Rules, acceptance of the Daily Prize as awarded, and agreeing to indemnify and release the Releasees (defined below); and (ii) agree to receive the Daily Prize eGift card through email transfer to the email address provided in the Entry Form, to be declared a winner (“Daily Prize Winner”, together with the Grand Prize Winner, the “Winners”, and each a “Winner”). The Sponsor, in its sole discretion, reserves the right to select another Entrant should a selected Entrant fail to do the aforementioned, or if found ineligible for any reason. If a Potential Daily Prize Winner cannot be contacted or fails to respond within ten (10) business days from the date contact is first attempted, they will forfeit their Prize, and an alternate winner may be selected, in the sole discretion of the Sponsor and time-permitting. Under no circumstance will Sponsor or any agent of Sponsor require or request Credit Card information or confidential bank account access or statements.
17. If at the end of the Contest Period there are any unawarded or unclaimed Daily Prizes, the Sponsor reserves the right, in its sole and absolute discretion to award such Daily Prizes through a random draw from amongst all eligible Entries, at a date beyond the Contest Period.
18. The Sponsor and/or its representatives may respond to entrants or otherwise engage with Contest participants during the Contest Period, but such interactions will have no impact on the process through which Prizes are awarded in accordance with these Rules.
19. PRIZE SUBSTITUTION: All Prizes available in this Contest must be accepted as awarded. No substitutions or transfers of Prize by Winner permitted. Sponsor reserves the right, in its sole discretion, in the event that a Prize or any component of any Prize cannot be awarded as described for any reason, to substitute and/or modify the Prize or component with (a) prize(s) of equal or greater value, without liability.
20. ENTRY CONDITIONS AND VERIFICATION: All Entries are subject to verification at any time. The Sponsor reserves the right, in its sole and absolute discretion, to require proof of identity and/or eligibility (in a form acceptable to the Sponsor including, without limitation, government-issued photo identification) to participate in this Contest. Failure to provide such proof to the satisfaction of the Sponsor in a timely manner may result in disqualification.
    Any attempt by any Entrant, to participate or submit an Entry in any method or enter or participate in any fashion not sanctioned by the Official Contest Rules will void that individual’s Entry and eligibility to win a Prize and the Entrant will be disqualified from the Contest, at the sole discretion of the Sponsor.
    All Entries that are incomplete, illegible, irregular, have been submitted through illicit means, or do not conform to or satisfy any condition of the Official Contest Rules may be disqualified by the Sponsor. Proof of submission does not constitute proof of receipt. Your Entry will be rejected if (in the sole and absolute discretion of the Sponsor) the Entry is not fully completed and submitted during the Contest Period. The Releasees (defined below) are not responsible for late, lost, misdirected, delayed, damaged, stolen, incomplete or incompatible Entries including but not limited to; any attempted Entry that may not be received due to technical issues, Entry Form timing out, incompatible web browser versions or internet connectivity issues during the Contest Period. Entries become property of the Sponsor and will not be acknowledged or returned.
21. LIMITATION OF LIABILITY: By entering the Contest, Entrants accept and agree to these Official Contest Rules and the decisions of Sponsor, which shall be final in all matters. The Releasees (as defined below) are not responsible for lost or late Entries, or the Declaration, or for any typographical, or other error in the printing of the offer, failure of the Contest website, administration of the Contest, or announcement of any Prize, or for technical, hardware, or software malfunctions, computer virus, bugs, tampering, unauthorized intervention, fraud, lost or unavailable network connections, or failed, incorrect, inaccurate, incomplete, garbled, or delayed electronic communications whether caused by the sender or by any of the equipment or programming associated with or utilized in this Contest, or by any human error which may occur in the processing of the Entries in this Contest, or any other cause beyond the reasonable control of Sponsor that interferes with the proper conduct of the Contest as contemplated by these Official Contest Rules. The Sponsor extends absolutely no representations or warranties in respect of a Prize and accepts no liability arising in respect of such Prize or in the use thereof.

22. RELEASES, WAIVERS, AND DISCLAIMERS:
    Unless otherwise required by applicable law, the Entrant agrees to the following releases, waivers and disclaimers:
    1. CONTEST RELEASE: By entering the Contest, Entrants agree to forever release, discharge, defend, indemnify and hold harmless, Sponsor, Promotion Parties, their affiliates, subsidiaries, their advertising and promotional agencies and their respective directors, officers, employees, representatives, successors, assigns and agents, parent and related companies, licensors, licensees (the “Releasees”), from and against any and all damages, claims, injuries, death, loss and/or liability to person or property, due in whole or in part, whether directly or indirectly, by the entering and participation in the Contest.
    2. PRIZE RELEASE: If an Entrant wins a Prize and accepts the Prize, such acceptance shall mean full satisfaction of the entitlement as an Entrant and Winner in the Contest and the Entrant fully discharges and forever releases the Releasees, of and from any and all claims, demands, losses, damages, actions or causes of action whatsoever, whether known or unknown, whether at law or in equity which they or their heirs, executors, administrators, successors or assigns may now or hereafter have against any of the Releasees in connection with the use, misuse or otherwise of the Prize.
    3. Entrant also acknowledges, without limiting the generality of the foregoing, that the Releasees will not be responsible for any injury, accident, death or dismemberment, or any other loss, damage or expense in connection with the acceptance of the Prize and participation in the Contest. Refusal to accept a Prize releases the Releasees of all responsibility and obligations toward the Entrant of such Prize.
    4. In no event shall Sponsor be held to award more Prizes than are mentioned in these Official Contest Rules or to award Prizes otherwise than in compliance with these Official Contest Rules.

23. RIGHTS OF SPONSOR: If, in the Sponsor’s opinion, there is any suspected or actual evidence of tampering with any portion of the Contest, or if technical difficulties or any other factor including accident, printing, administrative, or any error of any kind compromises the integrity, administration, or conduct of the Contest, the Sponsor reserves the right, to modify, cancel, or suspend this Contest without prior notice or obligation.
    Any attempt to deliberately damage any website or other component, or to otherwise undermine the legitimate operation of this Contest may be a violation of criminal and civil laws and should such an attempt be made, the Sponsor reserves the right to seek remedies and damages to the fullest extent permitted by law, including criminal prosecution.
    Sponsor reserves the right to disqualify a person if he/she enters the Contest or tries to do so by any means contrary to these Official Contest Rules or which would be unfair to other Entrants or where Contest Entries are generated by any mechanical or automated means, including the supply of untruthful, inaccurate, or misleading details and/or information. Entry materials that have been tampered with, reproduced, falsified, or altered are void. In the event a dispute arises as to the identity of an online potential Winner, Entries made by internet will be declared by the name on the associated online entry form.
    All federal, provincial, and local laws and regulations apply. This Contest and the Official Contest Rules shall be governed by, and construed in accordance with the laws of the Province of Ontario and the laws of Canada applicable therein in respect of residents of the other Canadian provinces/territories, without regard to conflicts of law principles.
24. PUBLICITY: Entering this Contest and accepting a Prize (if applicable) constitutes permission for the Sponsor, and its agencies to use the Winners’, names, cities and provinces/territories of residence and Prize information, for purposes of advertising and publicity in any and all media now or hereafter known throughout the world in perpetuity, without further compensation, notification, or permission, unless otherwise prohibited by law.
25. PRIVACY: Sponsor respects Entrants’ right to privacy. Personal information collected from Entrants (including but not limited to names, age, mailing addresses, telephone numbers, and email addresses) will only be used for the purpose of administering this Contest and conducting publicity about this Contest unless Entrants provide the Sponsor with explicit permission to do so by checking the information check-box on the Entry Form. By entering this Contest, Entrants consent to Sponsor’s collection, use, and disclosure of their personal information for these purposes. 26. LANGUAGE DISCREPANCY: Unless otherwise required by applicable law, in the event of any discrepancy or inconsistency between the English language version and the French language version of the Official Contest Rules, as applicable, the English version shall prevail, govern and control.
